These Special Terms define the specific procedure for domain name registration, renewal, transfer, and management services provided by NET MASTER LLC through the Nethost.am website.
These Special Terms form an integral part of the General Terms and Conditions of Nethost.am. In case of any conflict between these Special Terms and the General Terms, these Special Terms shall prevail with respect to domain name services.
The Provider offers domain name registration, renewal, transfer, and management services in accordance with the rules of the relevant domain zone, registry, registrar, ICANN rules, where applicable, and the legislation of the Republic of Armenia.
Registration and management of domain names in the .AM and .ՀԱՅ zones are also carried out in accordance with the rules of the Armenian domain registry and AMNIC.
To register a domain name, the availability of the domain name selected by the Client is checked first.
Information displayed on the website or in the Client Account regarding domain availability is preliminary and informational only and does not mean that the domain has already been registered in the Client’s name.
A domain is considered registered only after it has been successfully activated in the relevant registry, registrar system, or Provider’s system, and its status is marked as active.
To register a domain name, the Client fills in the required information on the Nethost.am website or in the Client Account and confirms the domain registration order.
The Client is required to provide accurate, complete, and up-to-date information, including the domain holder, administrative, technical, and billing contact details, where required by the rules of the relevant domain zone.
The Client is responsible for all risks and consequences arising from providing incorrect, false, incomplete information, or information that violates the rights of third parties.
The Client may register a domain through their Client Account in the name of a third party only if the Client has obtained that person’s prior consent and has the necessary authorization.
If it is discovered that a domain was registered in the name of a third party without that person’s consent or authorization, the Provider may suspend or cancel the domain registration. In such case, the amount paid is not subject to refund or recalculation, unless otherwise required by law or mandatory registry rules.
For domain name registration, renewal, transfer, or other domain-related operations, the Client pays according to the price list, invoice, or order terms published on the Nethost.am website.
Payment may be made by bank transfer, online payment systems, cash, or other methods offered by the Provider.
Payment is considered completed only when the funds are actually credited to the Provider’s account or to the Client Account balance and are identified with the relevant domain service.
The Provider has the right not to perform or to refuse domain registration if:
If domain registration is impossible because the domain is already taken or cannot be registered under registry rules, the Client may choose another domain name.
A refund of the paid amount is made only where the service has not actually been provided, the amount has not been transferred to the registry or a third party, and a refund is permitted by the rules of the relevant domain zone.
Confirmation of a domain registration order, payment, or clicking the “Register” button does not by itself mean that the domain has been registered.
A domain is considered registered only when its status becomes active or registered in the system of the relevant registry or registrar.
Until final registration, technical or registry restrictions may apply, and the Provider is not responsible for such restrictions where they are outside the Provider’s control.
During domain name registration, renewal, transfer, or management, the information provided by the Client may be transferred to the relevant domain registry, registrar system, AMNIC, ICANN, where applicable, and other authorized organizations.
This information may include the name, surname or company name of the domain holder, administrative, technical, and billing contact details, address, phone number, email address, DNS servers, and other information necessary for domain management.
Some information may be published in WHOIS or RDAP systems if required by the rules of the relevant domain zone or registry. If the relevant zone allows non-publication of data or privacy protection, the Provider may provide the relevant service or technical option.
If permitted by the rules of the relevant domain zone, the Client’s personal data may not be published in public WHOIS/RDAP systems or may be replaced with the Provider’s data or privacy service data.
In such case, the rights to use and manage the domain remain with the Client, unless otherwise provided by special terms.
If a mechanism for contacting the actual domain holder is available, the Provider forwards messages addressed to the Client within a reasonable period. However, messages may be missed due to spam filtering, incorrect addressing, technical failures, or actions of third parties.
The Client agrees not to use the domain name or related services for the following purposes:
The Provider may suspend, terminate, or cancel the domain registration service if:
In case of domain suspension or termination, the amount paid for the domain is generally not refunded if the suspension or termination is caused by the Client’s breach, incorrect information, prohibited use, or request of an authorized body.
The Client must pay the applicable domain renewal fee before the domain registration period expires.
The Provider may send reminders to the Client’s email address or phone number approximately two months and one month before the domain expiration date, informing the Client about the need to renew the domain.
Failure to receive a reminder does not release the Client from the obligation to renew the domain on time. The Client is solely responsible for monitoring domain expiration dates and making payments on time.
If the renewal fee for a .AM or .ՀԱՅ domain is not paid before the registration period expires, the domain may become publicly inaccessible.
After expiration, the domain may be kept for an additional 45 days with the possibility of renewal, unless otherwise provided by the registry rules in force at that time.
If the Client does not pay the renewal fee during the specified hold period, the Client loses the right to use the domain, and the domain may become available again for registration on general terms.
A domain transfer from one registrar or service provider to another is carried out in accordance with the rules of the relevant domain zone, registry, or registrar.
A transfer may require the consent of the domain holder, confirmation by the administrative contact, an auth/EPP code, or other actions required by the rules of the relevant zone.
The Provider is not responsible for failed transfers, incorrect data, expired domains, registry refusal, or third-party actions where such issues are not caused by the Provider’s fault.
The email address specified in the administrative contact of the domain or in the Client Account is considered the Client’s official contact address.
Messages received from that email address may be considered by the Provider as sufficient grounds to process the Client’s requests within the scope of services, unless the Provider has reasonable doubts regarding the authenticity or security of the request.
Amounts paid for domain name registration, renewal, transfer, or restoration are generally non-refundable if the order has been submitted to the registry, registrar, or a third-party supplier, or if the domain has been registered, renewed, or activated.
If domain registration was not completed due to the Provider’s fault and the amount was not transferred to the registry or a third party, the Client may request a refund or use the paid amount for another service.
In case of online payment refunds, bank fees, payment system fees, card transaction fees, or transfer fees may be deducted.
The Provider is not responsible for failure to register a domain, registry refusal, suspension, termination, or delay of domain registration where the reason is related to the registry, registrar, AMNIC, ICANN, third-party supplier, incorrect information provided by the Client, or actions of the Client.
The Provider is liable only for direct, documented actual damage caused to the Client due to the Provider’s fault, within the liability limits defined by the General Terms and Conditions.
Disputes related to domain name registration, renewal, transfer, suspension, or termination shall be resolved by the Parties through negotiations.
If no agreement is reached, disputes shall be resolved in accordance with the legislation of the Republic of Armenia, unless another mandatory procedure is required by the rules of the relevant domain zone.
These Special Terms are published on the Nethost.am website and may be amended by the Provider from time to time due to changes in law, registry rules, technical processes, or services.
The updated version is published on the website. Continued use of the services is considered acceptance of the amended terms.
These Special Terms may be published in Armenian, English, and Russian. In case of conflict or difference in interpretation between language versions, the Armenian version shall prevail.
